In December 2020, BCCI treasurer Arun Dhumal filed a petition at the Supre Court, asking for the cooling-off period to be removed. While the case was pending, the BCCI appealed in SC to ask for direction, allowing Ganguly and Shah another term, However, on Wednesday, the Supre Court decided that the matter should be heard by the panel led by Justice Chandrachud.
“I will be constituting a three-judge bench to hear this led by Justice DY Chandrachud,” the CJI said on Wednesday. The bench also included Justices Hima Kohli and CT Ravikumar.

Ganguly Shah BCCI Hearing: Why it is a setback for Ganguly & Shah?
- In 2018, Justice Chandrachud-led bench revised a 2016 order on the cooling off period.
- As per 2016 order, every office bearer needed to serve a cooling-off period for three years after every three-year term.
- In 2018, Chandrachud revised the previous order, mandating a three-year cooling-off period after two consecutive terms.
- However, as Chandrachud is in favour of a cooling-off period, BCCI won’t have it easy in convincing the panel on removing it altogether.
- As Sourav Ganguly and Jay Shah both have served two continuous terms at their respective state associations, both have already completed two terms.
- Hence, both will have to step down and take the cooling off period and can’t be associated with any state or BCCI office.
