However, the recent inclusions have forced the Government of India to take strong measures against them. As per the latest reports, the Tamil Nadu cabinet approves an ordinance to ban online gaming in the state. Online Gaming in Tamil Nadu

The Tamil Nadu cabinet approved an ordinance banning online gaming yesterday, and it would be promulgated after getting the assent from the Governor of the state, R.N. Ravi, an official statement said. Earlier, the Madras High Court had struck down the state’s ban on online games like rummy and poker with stakes, and the Tamil Nadu government had thereafter appealed to the Supreme Court.

The state government had informed the apex court stated that teenagers and youths were losing their entire earnings and savings by indulging in online games. In its petition, it also said that while rummy could be considered a game with skills, by placing stakes, it had turned into a gambling.

Renowned Technology & Gaming Layer, Jay Sayta around the ordinance announcement by the Tamil Nadu government to ban online gaming including online rummy, said, ” The Tamil Nadu government has issued a press release today stating that the cabinet has promulgated an ordinance to ban online gaming including online rummy and that the Ordinance has been sent to Governor RN Ravi for his assent. 

Whether games of skill are included in this legislation and are completely banned is still not clear as the draft legislation has not yet been placed in the public domain. It will be surprising if the state government once again decides to ban skill-based games for stakes, an activity that was held to be a fundamental right by the Madras High Court in August 2021.

The earlier legislation banning online skill-based games was struck down as unconstitutional by the High Court in 2021 and an appeal against the same is pending before the Supreme Court. Since the matter is sub judice before the Supreme Court and no stay has been granted against the High Court order and also as the next legislative assembly session is less than three weeks away, ideally the Governor should withhold assent to the ordinance.”
