The Supreme Court of India has ordered a sessions court in West Bengal to pass its decision on the domestic violence case against Indian cricketer Mohammed Shami. Shami’s wife Hasin Jahan claimed that the India fast bowler demanded dowry and was also involved in several illicit affairs.
A bench composed of the Chief Justice of India (CJI), DY Chandrachud, and Justices PS Narasimha and Manoj Misra issued the ruling after observing that the interim stay of the proceedings was only in effect until November 2, 2019.
Alternatively, the sessions court should decide the application by Jahan to lift the stay on Shami’s trial, the apex court directed.Jahan asked for the criminal case against Shami, who is accused of dowry demand and domestic abuse, to resume. Jahan pleaded with the Court to end the sessions court’s stay of the cricketer’s detention.
The plea further argued that a stay prevented the trial in this matter from moving forward for the previous four years. Shami hasn’t been in front of the trial court or even requested bail in the case, Jahan had also emphasised.
On a related point, a Kolkata court ordered Shami to pay Jahan alimony of 50,000 per month in January of this year.
