Alves was detained on January 20, 2023, on suspicion of sexual assault, which is said to have occurred on December 30 in Barcelona’s Sutton nightclub. He was arrested immediately following his arraignment and has been imprisoned at the Brians 2 jail in Barcelona ever since.

Former FC Barcelona defender Dani Alves will remain in custody as he awaits his rape charge trial in the Catalan capital. Tuesday, a Spanish judge once more rejected his request for bail release. Twice now, his legal team has failed to convince the court to let him wait outside of prison while the matter is being handled.

On January 20, 2023, Alves was taken into custody on grounds of possible sexual assault, which is believed to have taken place on December 30 in Barcelona’s Sutton nightclub. He was taken into custody just after his arraignment and has since been held at the Brians 2 prison in Barcelona.

When the inquiry first began, the football player presented conflicting accounts, which he later explained as a result of his wish to keep the adultery from his wife hidden. Although he has since modified his account multiple times, he has consistently said that there was no sexual assault. After originally denying everything, he has now acknowledged that he did engage in sexual activity with his accuser, but claimed everything was done with consent.

His team provided witness accounts and CCTV evidence from the scene, which they believe should refute the rape accusations. If Alves is permitted to wait for trial while under house arrest, he has also said that he is ready to give up his passport and wear a tracking device. All of these tactics failed to persuade the judge, and his most recent appeal was denied.If found guilty, Alves is facing a maximum sentence of up to 15 years in prison.
